These Terms of Use (“Terms”) govern your access to and use of the Houston Music Classifieds website, services, and any related pages, forms, and communications (collectively, the “Services”). The Services are operated by Houston Music Classifieds (“HMC,” “we,” “us,” “our”). By accessing or using the Services, you agree to these Terms.
If you do not agree, do not use the Services.
Who we are
HMC provides community-oriented resources such as show listings, community posts, opportunities, and other information intended to support the Houston music ecosystem. HMC is not a booking agency, ticketing provider, broker, escrow service, marketplace operator, or seller of goods.
Eligibility
You must be at least 18 years old to use the Services. If you are under 18, you represent that you have permission from a parent/guardian.
Accounts and Communications
Some features may require you to submit information (for example: forms, submissions, newsletter signups). You agree that information you provide is accurate and that you will not impersonate others.
You may opt in to receive emails and updates. Opt-out options will be provided where required by law.
Community standards and prohibited conduct
You agree not to:

Violate any law or regulation.

Post or share content that is unlawful, threatening, harassing, defamatory, hateful, discriminatory, or sexually explicit.

Post content that infringes intellectual property or privacy rights.

Post false, misleading, or deceptive information (including scams).

Attempt to disrupt, overload, scrape, reverse engineer, or interfere with the Services.

Use the Services to send spam or unsolicited promotions.

Collect others’ personal information without consent.

Use the Services to facilitate illegal transactions or regulated sales where prohibited.
We may remove content or restrict access at our discretion.
User submissions and content you post
The Services may allow you to submit content (such as event listings, opportunities, gear listings, comments, images, or links) (“User Content”).
You are responsible for your User Content
You represent and warrant that:

You own or have permission to post the User Content; and

Your User Content does not violate laws or third-party rights.
License you grant to HMC
By submitting User Content, you grant HMC a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and adapt your User Content as necessary to operate, promote, and improve the Services (for example: sharing a submitted show listing on the website or social media). You can request removal where feasible, but cached/shared copies may persist.
Show listings, opportunities, and information accuracy
HMC may post information submitted by community members or third parties. We do not guarantee accuracy, completeness, or timeliness. Dates, lineups, locations, age restrictions, ticketing links, and policies can change. You are responsible for verifying details directly with venues, promoters, artists, and ticketing providers.
HMC is not responsible for:

Canceled or rescheduled events

Venue policy changes

Ticket disputes, refunds, chargebacks, or entry issues

Injuries, damages, losses, or disputes arising from events listed on the Services
Gear listings and community marketplace disclaimer
If the Services include a section for buying/selling/trading gear or other items (“Community Board”):

HMC does not facilitate transactions and is not a party to any deal.

No escrow, payment processing, shipping, returns, warranties, or verification are provided by HMC.

Any meetups, exchanges, and communications are at your own risk.

You are solely responsible for: verifying identity, inspecting items, negotiating terms, determining fair price, complying with tax obligations, and following all applicable laws.

HMC is not responsible for fraud, theft, misrepresentation, injury, or losses arising from Community Board activity.
Safety suggestion: meet in public places, bring a friend, use secure payment methods, and trust your instincts.

Donations, fundraising, and payments
If HMC accepts donations or sells merchandise/tickets for HMC-run events, additional terms may apply at checkout or on the relevant page. Unless stated otherwise, donations are non-refundable to the extent permitted by law.
Intellectual property
The Services and their original content (excluding User Content), including text, branding, logos, graphics, and site design, are owned by HMC or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or exploit HMC materials without permission, except as allowed by law.
Copyright complaints
If you believe content on the Services infringes your copyright, send a notice to: info@houstonmusicclassifieds.com with:

We may remove content and/or terminate repeat infringers where appropriate.
Third-party links and services
The Services may link to third-party websites (venues, ticketing sites, payment processors, social platforms). HMC does not control and is not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.
Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, HMC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HMC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.
Indemnification
You agree to defend, indemnify, and hold harmless HMC and its officers, directors, volunteers, contractors, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:

Your violation of these Terms

Your violation of any law or third-party rights
Termination and enforcement
We may suspend or terminate access to the Services at any time for any reason, including suspected violations of these Terms. We may also remove or restrict content at our discretion.
Changes to the Services or Terms
We may update the Services and these Terms from time to time. The “Effective Date” will reflect the latest version. Continued use after changes means you accept the updated Terms.
Governing law and venue
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute arising from these Terms will be brought in the state or federal courts located in Harris County, Texas, and you consent to jurisdiction and venue there.
Miscellaneous

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No waiver: Failure to enforce a provision is not a waiver.

Entire agreement: These Terms and any referenced policies (including a Privacy Policy, if posted) are the entire agreement regarding the Services.
